Refund Dispute

Mads (Calgary)

Can a business legally hold a customer's deposit?

During the negotiation process, they asked me to sign a Work Sheet, which detailed the terms of the proposed sale. However, there was no explicit mention or explanation of a non-refundable clause in the fine print of the document. At no point was I made aware of any non-refundable terms, and I signed the Work Sheet under the assumption that the deposit was refundable if the sale did not go through. A bill of sale was not signed at all.

I am not certain what kind of transaction this was but in general, the business had to give you ten days to change your mind under the Consumer Protection Act. You should contact a lawyer about this.
