EPO and Service

I currently have an EPO against my ex. We jointly own a life insurance policy for our child. He has not contributed to the policy since we split 4.5 yrs ago. I'm wanting to assume it. Am I able to serve him or have him served via email for the ownership change forms? Or does it need to be by a process server?

Hi Meghan,

The life insurance ownership change forms are not court forms, so there are no rules governing how your ex should receive them. However, given the EPO, you should NOT serve him yourself in person.

To avoid a future issue of your ex claiming that he didn't receive the forms, and if it's safe to do so, you can have a trusted friend or family member serve him in person. You can also serve him by registered mail where proof of signature of the recipient is available.
