Recalculating Child Support and enforcing sobriety order

Brook (Blackfalds )

My ex husband and I divorced about 2 years ago. In the order signed by the judge it said that we would do our calculation annually. When the first year came up we verbally agreed to skip it. Then the second year came and I asked if we could do the recalculation. He tried to manipulate me and guilt me into not doing it. I offered to do it through lawyers if he wouldn’t agree and he then offered to do it on our own but that he had to wait until he filed his taxes. That was over 6 months ago. I brought it up to him again and he said that he was waiting for his accountant to email him and then never got back to me. We also have a sobriety order that I believe he’s broken but I don’t have proof. He keeps making plans that force me to have the kids when it’s supposed to be his time. I want to know what my options are legally.

Register with the Alberta Justice Child Support Recalculation Program and they will assist to recalculate your child support each year by obtaining income information from each party. If one party is self-employed, they may not be able to help so go to the below option.

Or, you could try the below for child support; see the email addresses;

If child support is in issue, have you met with a King’s Bench Child Support Resolution Program (KBCSRP) Officer? ☐ Yes ☐ No
If Yes, when Please specify?

(If you have attended the Program, please attach the KBCSRP Report to this Notice to Attend.)

(If you have not attended the Program, you may do so voluntarily without first attending Family Docket Court. If child support is in issue and you have not met with the KBCSRP Officer, the Family Docket Court Justice may require you to do so before any further steps may be taken.)
Please note that the KBCSRP Officer will deal with spousal support only if child support is also in issue.

Thank you for the info! I just reread our child support order from the signed divorce act, it states that our order shall not be recalculated by the Alberta child support recalculation program. And I never applied for maintenance enforcement. Is that something I should or can do?
