Trust Account

While we are going through our financial settlement, the house funds are sitting in a trust account. All other property has been divided and we are already divorced in February. My ex has a lawyer and he will not agree to to release any money while we wait for the financial discovery to be finalized. It has been two months and he is still not finished. How long do they have to get this completed and is there any way to petition the courts for a small payout while we await for the financial disclosure to be finaished.

If both parties consent, you can get an interim distribution or payout either by Order or by a Joint Letter of Direction from family lawyers to conveyancing lawyer holding the net sales proceeds. If the proceeds are being held in a non-interest bearing account, parties should be pushing their counsel to reach agreement on family property division.
