SoC Response Time Question

Sarah (Calgary)

I served my spouse my SoC for divorce. He has reviewed the contents therein, and voluntarily signed the proposed divorce judgement, and an undertaking to not appeal, days after receipt of the SoC.

Since he has consented to, and undertaken same; can I file the remaining documents prior to the 20 day response deadline? Further, if I do file same within the 20 days, can he file a different response than what he consented too?

If he has signed the proposed divorce judgment and undertaking not to appeal, you may file the remainder of the documents. Once those are filed, it will be difficult for him to file a response if it runs contrary to the filed consent judgment.
