Child Support

Stephanie (St.Albert)

I have gone through over 10 k in legals fees for a high conflict case and no lawyer has brought into court for child support and arrears owed, I keep being brought into settlement meetings that do not have a result. My ex has not paid child support for 1 year and 1 month. How do I apply in court myself to have this order issued? There was a filed statement for claim of divorce and child support in March, my ex still hasn't supplied all the information for their financial disclosure. I can no longer afford a lawyer and I need this to be put into an order. They earn alot more than I do, the amount is calculated but no action has been made.

Without knowing specifically what steps have been taken, we can only provide general information and suggestions. If you haven't already, you could try the Child Support Resolution Program, offered through Court of King's Bench: https://www.alberta.ca/child-support-resolution-program
If you're able to reach agreement, the staff lawyer will help prepare a consent order. If not, they will provide more information about what you can do next, and may refer you to other programs.

If you want to proceed straight to court, you can file a Notice to Attend Family Docket Court: https://albertacourts.ca/kb/areas-of-law/family/family-docket-court

You can also contact a family court counsellor for assistance in navigating the court system and preparing court forms: https://www.alberta.ca/family-court-assistance
